Natural Heritage New Mexico (NHNM) and other data providers to EnviroData-NM shall not be held liable for any improper or incorrect use of the information contained herein and assumes no responsibility for the use of the information. In no event shall the above parties be liable for any direct, indirect, or incidental damages arising in any way out of the use of this service. These data have been processed successfully on computers of NHNM and their partners and no warranty, expressed or implied, is made by NHNM and our data partners regarding the use of these data on any other system, nor does the fact of distribution constitute or imply any such warranty. In no event shall NHNM and our data partners have any liability whatsoever for payment of any consequential, incidental, indirect, special, or tort damages of any kind, including, but not limited to, any loss of profits arising out of use of or reliance on the data provided by EnviroData-NM or arising out of the delivery, installation, operation, or support of the Tool by NHNM. This site is not monitored by NHNM for any failure of performance, error, omission, defect, delay in operation or transmission, computer virus, alteration or use of record. Users of the information available on this website assume any risk of using or relying on information contained herein.

While NHNM and our data partners attempt to provide the most accurate information possible, this spatial and other data is "as is" and NHNM and our data partners make no guarantee or warranty concerning the accuracy, adequacy, completeness, reliability, or usefulness of any information contained in EnviroData-NM. The aforementioned parties further make no warranties, either expressed or implied as to any other matter whatsoever, including, without limitation, the condition of the product, or its fitness for any particular purpose. The burden for determining fitness for use lies entirely with the user. Information in EnviroData-NM comes from a variety of different sources, with varying levels of certainty.

Information is added and changed periodically, and data may become out-of-date quickly. It is recommended that the user not let a significant period of time elapse between obtaining and using the information. NHNM and our data partners deny responsibility for the conduct of the users of EnviroData-NM.

EnviroData-NM is constantly being updated and expanded. Information contained in EnviroData-NM does not constitute an official opinion by NHNM or our data partners, nor will it, by itself, meet any regulatory requirements.

Digital Data Disclaimer

These data are a product and property of NHNM and NHNM's data partners who have provided data for EnviroData-NM. These data are strictly "on loan" and should be considered "works in progress". Data maintained by NHNM database are an integral part of ongoing research and reflect the observations of many scientists, institutions and our current state of knowledge. These data are acquired from various sources, with varying levels of accuracy, and are continually being updated and revised. Many areas have never been surveyed and the absence of data in any particular geographic area does not necessarily mean that species or ecological communities of concern are not present. These data should not be regarded as a substitute for on-site surveys required for environmental assessments. Absence of evidence is NOT evidence of absence. Absence of any data does not mean that other resources of special concern do not occur, but rather NHNM files do not currently contain information to document this presence. NHNM and its data partners are not responsible for whether other, non-NHNM partner data providers have secured landowner permission for data collected.

Under no circumstances are data to be distributed in any fashion to outside parties, please refer all requests for the data to original owner/creator of the data resource as reflected in the metadata. To ensure accurate application of data, tabular and narrative components must be evaluated in conjunction with spatial components. Failure to do so constitutes a misuse of the data. NHNM and its data partners shall have no liability or responsibility to the data users, or any other person or entity with respect to liability, loss, or damage caused or alleged to be caused directly or indirectly by the data, including but not limited to any interruption of service, loss of business, anticipatory profits or indirect, special, or consequential damages resulting from the use of operation of the data. Data users hereby agree to hold NHNM, its data partners, the University of New Mexico, and the State of New Mexico harmless from any claim, demand, cause of action, loss, damage or expense from or related to data users use of or reliance on the data, regardless of the cause or nature thereof, and even in the event that such cause is attributable to the negligence or misconduct of NHNM.

These data are provided on an as-is basis, as-available basis without warranties of any kind, expressed or implied, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Although NHNM and our partners maintain high standards of data quality control, NHNM, its data partners, The University of New Mexico, and the State of New Mexico further expressly disclaim any warranty that the data are error-free or current as of the date supplied.
